首先，法律上，對於打麻將來説，並不是完全反對打麻將，一説打麻將就肯定會被處罰
一般來説，如果就是偶爾幾個人，賭的不大，並不是以賭博為職業，性質更多體現買娛樂，都不會算作賭博。
麻將館若抽成涉嫌違法
對於麻將館來説，也並不是一羣人打麻將，就算聚眾賭博，甚至也不是只要賭的大，就算開設賭場。根據司法解釋不以營利為目的，進行帶有少量財物輸贏的娛樂活動，以及提供棋牌室等娛樂場所，只收取正常的場所和服務費用的經營行為等，不以賭博論處。
